Who Is Dr. David Beary?
Dr. David Beary is a 71-year-old gastroenterologist who practiced at St. Bernard Parish Hospital in St. Bernard Parish, Louisiana. He is licensed to perform gastrointestinal procedures, such as endoscopies and colonoscopies, which often require sedation and involve significant trust between a patient and their provider.
St. Bernard Parish Hospital is operated by Ochsner Health. Ochsner has stated that Beary was not directly employed by the hospital or the health system and that he has not treated patients at the facility since May 1, 2026. The hospital’s CEO has said it took immediate action after learning of the allegations and is cooperating with law enforcement and regulatory authorities.
Can I File a Lawsuit Against Dr. Beary or St. Bernard Parish Hospital?
Filing a lawsuit against Dr. Beary, St. Bernard Parish Hospital, or both may be possible, though the applicable legal theories and deadlines differ. The only way to know for certain whether you have a case is to speak with an attorney who can review your specific situation.
Louisiana law generally allows two years to file most negligence-based lawsuits, under La. Civil Code article 3493.1. A separate provision, La. Civil Code article 3496.2, sets a three-year window specifically for civil sexual assault claims, running from the date of the injury or from the date law enforcement identifies the offender, whichever is later. These deadlines can be revised by future legislation, so confirming the current statute with an attorney is an important step before relying on either figure.
An individual claim against Beary and an institutional negligence claim against the hospital may both be options worth discussing with an attorney, depending on the facts of your situation.

Allegations Against Dr. Beary
The allegations against Beary center on conduct during medical procedures at St. Bernard Parish Hospital, including incidents involving sedated patients.
The Charges and Arrest
The St. Bernard Parish Sheriff’s Office issued a warrant for Beary’s arrest on four counts of misdemeanor sexual battery. Beary turned himself in, was booked at the St. Bernard Parish Correctional Facility, and was later released after posting a $20,000 bond.
According to Fox 8 Live’s reporting, a source said Beary allegedly touched patients’ breasts inappropriately during medical procedures at the hospital, and that some of the allegations involve patients who were sedated at the time.
Beary's Response
Beary’s attorney, Eugene Redmann, has publicly denied the allegations against his client. Redmann told Fox 8 Live that Beary has practiced medicine for more than 40 years without any prior allegations of this kind, and he questioned the case’s reliance on a single witness’s report.

St. Bernard Parish Hospital's Alleged Negligence
In addition to the criminal case against Dr. Beary, two civil lawsuits were filed against Beary, St. Bernard Parish Hospital, and Ochsner Health asserts claims of institutional negligence. The lawsuit alleges hospital staff learned of Beary’s alleged sexual battery of the patients on the same day it occurred, but the hospital did not notify the affected patients for over a month.
Under general negligence principles, an employer or facility can be held responsible when it fails to act on or disclose known misconduct in a timely way. A Louisiana attorney can review the specific facts of a case to explain how this type of institutional liability claim may apply.
What Survivors of Doctor Sexual Assault Should Know About Their Rights and Options
If you experienced any form of medical sexual assault by a doctor or other medical provider, you have rights and options for pursuing accountability and support.
Examples of Doctor Sexual Assault
Doctor sexual assault can take many forms, and recognizing it can be hard when it happens during care you trusted. These examples are not exhaustive, and you may see yourself in one or more of them:
- Inappropriate touching during exams or procedures.
- Sexual contact with a sedated or unconscious patient.
- Sexually suggestive comments made before, during, or after an appointment.
- Exams performed without proper consent or without a chaperone present when one was requested.
Many survivors do not immediately recognize behaviors like unnecessary touching, sexual comments during care, or exams performed without proper consent as abuse, especially given the trust patients place in medical professionals and the fact that many exams and procedures already involve touching intimate parts of the body for legitimate medical reasons. If something about a past exam or procedure felt wrong to you, you are not alone, and you have options for understanding what happened and what you can do next.
Reporting Doctor Sexual Assault
Survivors have several options for reporting medical sexual assault, and choosing whether to report is a personal decision.
- Report to the Louisiana State Board of Medical Examiners through its complaint and investigations process.
- Report to local law enforcement.
