New York Prison Sex Abuse Lawsuit

In New York, sexual abuse or assault of an incarcerated person is a crime, but inmates often find it difficult to seek medical care or report misconduct due to a fear of further abuse or retaliation. Types of Sexual Abuse in New York Prisons

Prison inmates have constitutional rights protecting them from abuse, neglect, or harassment while incarcerated. Under New York law, prison inmates lack the legal capacity to consent to sexual activities with those in positions of authority, such as corrections officers and other staff members. Therefore, any sexual contact between inmates and prison staff, including the following, is considered sexual assault:

  • Inappropriate or unnecessary strip searches
  • Inappropriate touching
  • Groping and fondling
  • Sexual assault, including forced oral sex
  • Rape
  • Offers of extra food, drugs, perfume, or other items in exchange for sexual acts
  • Retaliation for refusing sexual advances by staff, including disciplinary action

Prison abuse can occur in any government detention facility, including jails, prisons, and juvenile detention centers.

Lawsuits and Allegations of Sex Abuse in New York Prisons

At least 750 individuals have come forward to file lawsuits against the State of New York over alleged sexual assaults during their incarceration at the state’s prisons. They accuse state officials of failing to protect inmates at the Bayview Correctional Facility, Rikers Island, Bedford Hills, and other state facilities.

Many of these lawsuits were filed in the wake of the New York Adult Survivors Act, which took effect in 2022 and significantly expanded the statute of limitations for rape cases. Thus, some of the allegations date back to the 1980s.

Prison Abuse at Rikers Island

In recent years, over 800 lawsuits have been filed against the New York City Department of Corrections and Community Supervision, or NYDOCCS, over alleged sexual abuse at Rikers Island that dates back decades. In fact, over half of all sexual abuse lawsuits filed under New York City’s Adult Survivors Act’s one-year lookback window, which expired in November 2023, involved assaults by guards at Rikers Island.

In December 2025, one victim filed a federal lawsuit alleging that two corrections officers sexually assaulted him at Rikers during a retaliatory strip search. He further claimed that footage of the assault later disappeared.

Detainees at the complex have argued that officer abuse is rarely properly investigated. They noted that it took officials seven years to fire one officer for an illegal sexual relationship with a detainee, while another was accused of rape by 24 women over decades, but never fired.

Prison Abuse at Bedford Hills Correctional Facility

Bedford Hills Correctional Facility is a women’s prison in New York with a long history of sexual abuse and assault allegations. In 2022, at least 900 former inmates came forward and filed lawsuits alleging they were sexually assaulted in New York state prisons, including Bedford Hills.

Prison Abuse at Taconic Correctional Facility

In April 2025, a former inmate of the Taconic Correctional Facility filed a lawsuit against the state of New York for $20 million, alleging that state prison officials failed to protect her from an officer who forced her to perform sexual favors in 2018. At least six former inmates have raised similar accusations against the same guard.

Prison Abuse at Bayview Correctional Facility

In another lawsuit filed in April 2025, one survivor said the same guard from the Taconic lawsuit raped her on three occasions in 2007 and 2008 at the now-closed Bayview Correctional Facility. She is also suing the state for $20 million. The accused officer, Pedro Norde, has denied the allegations, and there has been no administrative finding that he committed sexual misconduct.

Meanwhile, prior disciplinary actions against him did not result in termination. The state reportedly attempted to fire Norde in 2019 for inappropriate contact with a parolee, but an arbiter allowed him to keep his job and awarded him almost $300,000 in back pay. Alleged victims say the state knew of a widespread sexual abuse problem in all state female prisons, and better supervision could’ve led to Norde’s termination.

Reporting to the NY Department of Corrections

To report sexual assault, abuse, or harassment at an NYCOCCS facility, contact the DOCCS Office of Special Investigations online or call 1-844-OSI-4NYS (1-844-674-4697). Victims who are still incarcerated can use the 444 speed dial on tablets or phones to report incidents.

Reporting to Local Law Enforcement

In addition to reporting to NYDOCCS, survivors can also report prison abuse to local law enforcement by calling 911 or visiting their local police or sheriff’s office.

File a Sexual Assault Lawsuit for Prison Abuse in New York

In 2019, New York amended its statute of limitations to give adult survivors of certain sex crimes 20 years to file a civil lawsuit. However, that law is not retroactive. Thus, survivors of abuse that occurred before the law’s 2019 effective date only had three years to file suit.

New York City recently amended its Gender-Motivated Violence Act to create an 18-month lookback window that revives previously expired claims. If the sexual abuse occurred before January 9, 2022, you now have until July 2027 to file suit. If your claim arose after that date, you have at least seven years from the date of the incident to file suit.
