On August 11, 2025, a civil complaint was filed in the Supreme Court of New York, County of New York on behalf of a 21-year-old patient alleging sexual abuse during a medical examination at Modern MD Urgent Care’s Woodhaven, Queens, facility.
The lawsuit names Modern MD Management Services, LLC, Modern MD Urgent Care – Woodhaven, and Dr. Amir Sitafalwalla as defendants. According to the filing, the patient alleges inappropriate touching during a genital exam that he contends was not medically necessary.
History of Allegations
Dr. Sitafalwalla has a history of allegations against him. According to the lawsuit, he was terminated from a position with CityMD in 2021, where he allegedly sexually abused two patients. Then in January 2023, after being hired by Modern MD Urgent Care, he was accused of groping a patient who had visited for a COVID-19 test. Following a separate incident in August 2024, he was arrested in September and charged with forcible touching and sexual abuse.
Dr. Sitafalwalla was held on $10,000 bail, which he then posted. It was the August 2024 incident for which the victim is now moving forward with a complaint against the facility.
