Former Patient Alleges Doctor Abuse at NY Urgent Care

On August 11, 2025, a civil complaint was filed in the Supreme Court of New York, County of New York on behalf of a 21-year-old patient alleging sexual abuse during a medical examination at Modern MD Urgent Care’s Woodhaven, Queens, facility.

The lawsuit names Modern MD Management Services, LLC, Modern MD Urgent Care – Woodhaven, and Dr. Amir Sitafalwalla as defendants. According to the filing, the patient alleges inappropriate touching during a genital exam that he contends was not medically necessary.

History of Allegations

Dr. Sitafalwalla has a history of allegations against him. According to the lawsuit, he was terminated from a position with CityMD in 2021, where he allegedly sexually abused two patients. Then in January 2023, after being hired by Modern MD Urgent Care, he was accused of groping a patient who had visited for a COVID-19 test. Following a separate incident in August 2024, he was arrested in September and charged with forcible touching and sexual abuse. 

Dr. Sitafalwalla was held on $10,000 bail, which he then posted. It was the August 2024 incident for which the victim is now moving forward with a complaint against the facility.

Legal Action and Accountability

The civil complaint claims that Modern MD failed to adequately hire, supervise, and oversee Dr. Sitafalwalla, potentially putting patients at risk despite these prior incidents.

The victim seeks damages for the injuries allegedly caused by Dr. Sitafalwalla’s actions and by the clinic’s institutional failures, including negligent hiring, retention, and supervision. As the case is pending, all allegations remain unproven.
