Santa Clara County Juvenile Hall is a co-ed detention facility in San Jose, California that houses minors while they wait for court decisions or serve their sentences. Juvenile detention centers are intended to rehabilitate and protect youth. But across California, these facilities have faced lawsuits for failing to do so. Survivors from counties such as San Diego, Los Angeles, and San Bernardino have come forward with allegations of sexual abuse by probation officers, counselors, and other staff. The lawsuits alleged widespread failures in screening, supervision, and discipline that allowed abuse to occur.  In 2021, a juvenile court counselor in Santa Clara County was arrested on multiple counts of sexual assault of a minor under 14. The arrest followed reports for victims spanning years, including a juvenile, who have raised concerns about the same counselor 15 years earlier.

For survivors of juvenile detention sexual abuse, there are legal rights and options. Victims may report abuse to the Santa Clara County Probation Department, social services, or state oversight agencies such as the Office of Youth and Community Restoration or the California Bureau of Children’s Justice. Survivors also have the right to pursue civil lawsuits against responsible staff members and the county staff. California law sets filing deadlines known as the statute of limitations for childhood sexual abuse cases. In 2019, the law extended these deadlines, allowing survivors to file claims up until their 40th birthday or within 5 years of discovering the harm. A separate law effective in 2024 removed the statute of limitations entirely for abuse that occurred on or after January 1st, 2024. Abuse that took place before that date still falls under the 2019 deadlines.
