What is eXp Realty?

Founded in 2008, eXp Realty is a fast-growing real estate brokerage. It markets itself as an innovative cloud-based brokerage that enables any licensed real estate agent to join their company and earn commissions. They have 87,000 agents in 24 countries. Agents based in the U.S. have reportedly earned over $176 million through revenue sharing in 2023.

However, some have alleged that eXp Realty is a multi-level marketing scheme, given its push for agents to recruit other agents to join and its revenue-sharing model. Meanwhile, numerous sexual misconduct allegations have rocked the company, with several women alleging they have been sexually assaulted.

In 2024, shareholders of eXp World Holdings, the parent company of eXp Realty, filed a derivative lawsuit against the company for the alleged mishandling of sexual harassment and workplace sexual assault at the company.

eXp Realty Lawsuits & Scandals

In December 2023, the New York Times published an investigative report after five women filed lawsuits against eXp Realty and company officials, claiming eXp agents drugged the women and sexually assaulted four of them. The women also claim that eXp executives ignored their complaints until the first lawsuit was filed in February 2023.

The complaints name two agents as the perpetrators who drugged and assaulted them: Michael Bjorkman and David Golden.

Several other women have claimed they told eXp Realty about sexual assault and sexual harassment incidents, but the company did not properly investigate the allegations or prevent further harm. Several women claim that after they came forward, the company let them go or offered them money to leave the company. The following is a timeline of the current litigation:

  • February 2023: Fabiola Acevedo, Tami Sims, Christiana Lundy, and a Jane Doe filed the first eXp Realty lawsuit against the parent company and eXp Realty, Michael Bjorkmann, David Golden, and several unnamed individuals.
  • December 2023: Anya Roberts filed the second lawsuit against the company and affiliated individuals. She amended her complaint in June 2024. Currently named as defendants are eXp Realty LLC, eXp World Holdings, Michael Bjorkman, David Golden, Brent Gove, Emily Keenan, Glenn Sanford, Michael Sherrard, and several unnamed individuals.
  • October 2024: Shareholders filed a derivative lawsuit against the company, Glenn Sanford, Jason Gesing, and five other board members of eXp World Holding for their mishandling of the sexual assault allegations and breaching their fiduciary duty.

The New York Times article also said that other women have come forward with allegations of sexual abuse with allegations against two other eXp-affiliated individuals—eXp agent Randy Bocook and Nicholas Moore, a real estate photographer and vendor at an eXp Realty event.

As of January 2025, these lawsuits are ongoing. Michael Bjorkman was arrested in Miami-Dade County in March 2021 on two counts of sexual assault, but the case did not proceed for unspecified reasons. Bjrokman and Golden were removed from the company in 2020 and 2023, respectively, and investigations into the allegations against them and others continue.

Rights & Options for eXp Realty Agents Impacted by Sexual Abuse & Harassment

While several individuals have already come forward and filed claims against eXp Realty and relevant third parties, many more individuals nationwide are believed to be impacted by the widespread sexual misconduct at eXp events.

Report the Sexual Abuse to eXp Realty’s Human Resources Department

Due to its corporate structure and designation of all realty agents as contractors, the company’s process for reporting harassment allegations is relatively unclear. Its policy reportedly advises agents who feel threatened to contact a member of eXp’s corporate team or the broker responsible for their real estate license under state law. However, the policies fail to specify which corporate member to contact and do not provide guidance on how brokers and executives should handle such reports.

Additionally, given the allegations that eXp Realty ignored internal complaints seriously and retaliated against those who did come forward, we highly recommend speaking with an experienced attorney before filing a complaint with HR.

Report to Law Enforcement

You have a legal right to report the misconduct to law enforcement. You must generally do this in person at the local police precinct in the jurisdiction where the harm occurred. While private individuals cannot press criminal charges—a prosecutor ultimately determines whether to bring charges—filing a police report will trigger an investigation that may result in charges. It also creates a valuable paper trail that might help others who come forward. 

So far, most of the sexual abuse allegations involve misconduct that occurred at eXp Realty events around the country, making it difficult for individuals to report the abuse locally. We suggest calling the local police precinct in the jurisdiction where the harm occurred and asking if you can file a report online or by phone. 

According to the New York Times investigation, at least nine of the incidents reported to police involved drugging and assault by Michael Bjorkman between 2000 and 2020.
